Pursuant to Regulation (UE) 2016/679, General Data Protection Regulation concerning the protection of personal data (GDPR), applicable from May 25, 2018, and Spanish Organic Law 3/2018 on Personal Data Protection (LOPDGDD) we provide the following basic information:

CASE ON IT, S.L. has designated a data protection officer (DPO) to which you can send an e-mail to. The data protection delegate is the person responsible for ensuring the protection of the fundamental rights to the protection of personal data.

In this way, CASE ON IT, S.L. continues to guarantee the security and confidentiality of your personal data and gives you more control over your personal data, to be able to decide who accesses your data, in what conditions and for what Purpose. All anonymous and pseudonymous data is stored and processed in the European Union.

2. Overview

Case On IT SL (also known as MedUX, “We”) are committed to ensuring that your privacy is protected and we shall endeavor to use any information that you provide when using our Solutions in accordance with this privacy policy. Our policy and processes comply with the European Union General Data Protection Regulation introduced in May 2018.

MedUX is the global leader in Quality of Experience (QoE) testing and monitoring with a unique fixed and mobile convergent QoE insights suite. We are specialized in comprehensive and innovative multi-platform solutions mainly for telecom operators and regulators to test, benchmark and monitor next generation networks.

Our SDK and APPs, our Solutions, are available on iOS, Android and Harmony and supports various QoE measurements both in cellular and Wi-Fi. Our solutions help end users to examine their real internet performance by providing friendly tools with added value information. 

This privacy policy is written to ensure that you understand what information we collect when you use our Solutions, how we protect any information you submit to us, how we use it and your rights and choices.

We may amend this policy from time to time by updating this page. Therefore, we suggest you check this page occasionally to ensure you are aware of and are happy with any amendments.

3. Why do we collect the information?

We collect data so that we can help telecom operators, telecom regulators, network equipment manufacturers, and other telecom industry stakeholders better understand, compare and improve quality of service and quality of experience. Our data is only used within the telecommunication industry and only for the purposes of understanding, communicating, and optimizing network and service performance.

4. What Information Do We Collect and How Do We Collect It?

Our Solutions, with the appropriate end-user permissions, run in the foreground or background in order to collect technical data related to network and service performance. All of our applications and mobile application partners provide disclosures and permission requests to their users to enable data collection. All information we collect is kept pseudonymous or anonymous at all times.

In order to measure network and service performance, depending on users' permissions (which can be changed at any time in the APP settings or in the end-user device settings), we may collect the following information:

  • Internet Service Provider.
  • Type of mobile network coverage: Null, off, limited, 2G, 3G, 4G or 5G. 
  • Type of Wi-Fi coverage.
  • Information about connected Wi-Fi networks and neighboring networks, their configuration, and signal strength. 
  • Mobile network parameters such as connection type (2G/3G/4G/5G), signal strength, RSRQ, CQI and TA, in addition to other network quality metrics 
  • Internet service measurements such as video streaming quality, webpage browsing speed, gaming and OTT services responsiveness and performance. 
  • Voice services network quality during the calls.
  • Location of the measurements and data collection.
  • Device status information: Battery, CPU, memory usage, etc.
  • Bandwidth usage of third-party applications.

When you use our applications, we may also gather information about your device and app usage (such as your device, your IP address, your location as provided by your device's location system where you have installed any of our apps and your approximate general location derived from your IP address).

Every end user agrees and opts in to sharing this data with MedUX in accordance with their mobile application’s permissions and privacy policy. We require that all appropriate consents are granted.

5. Aggregated (summary) Data

We may use any data relating to the speed of your Internet connection to provide aggregated data relating to speeds in and around your area. You can see an example of this by checking our map in our apps which shows other results. This is not personal information and is not linked to any personal information that we have.

Collected Location Data

This section describes what we collect, how our apps determine your location and explain that it cannot be used to personally identify you.

We may use and store information about your location if you give us permission to do so in the app. We use this data to provide features of our Service, and to improve and customize our Service. You can enable or disable location services when you use our Service at any time, through your device settings.

When Case On It is requested to provide a location result, we may collect approximate location information that is provided or generated in any of the following ways:

  • GPS coordinates or other device location methods as provided by the operating system.
  • Using the MAC address of wireless routers (an alphanumeric code that is unique to that hardware device)
  • Using the Received Signal Strength Indicator (a measurement of the strength of the access point’s signal at the time it is received by the mobile device) to identify the cell ID of nearby cell towers
  • Using the IP address of the requesting device, Bluetooth UUID’s, Received Signal Strength Indicator and associated Bluetooth data.

This location data is collected anonymously in a form that does not personally identify a user. The location data along with speed tests and network measurements may be shared with telecom operators, telecom regulators, network equipment manufacturers, and other telecom industry stakeholders to compile aggregate information about network statistics, coverage and performance in particular geographical areas.

The IP address information we collect is not associated with you or any other individual and, for this reason, is not Personal Information.

6. Changes and updates

We reserve the right to modify this Policy at our discretion. This policy may be updated based on legislative and regulatory requirements, or in order to adapt said policy to the instructions issued by the Data Protection Authority. Users are advised to  review this privacy policy regularly to ensure that you are aware of any changes.

The continued use of the Services, once the changes have been notified, will be subject to the updated texts.

7. Duration

We will process your data as long as your are a collaborator or user of MedUX Services and once the relationship with us is over, during the limitation periods of the obligations arising from the treatment.

8. Lawful Bases for Processing

The legal grounds for the use and treatment of the data are as follows: the consent of the person providing information through the use of our applications or forms provided, the fulfilment of legal obligations and/or the legitimate interest of the Data Controller in maintaining professional contact and sending commercial communications about its products and services.

The lawful bases we use for processing your data depends on the Services and Apps you use. We collect and process your data when:

  • It is necessary to provide and operate the Services and Apps we provide and to offer support and other necessary features. This is a Contract Basis.
  • It satisfies our Legitimate Interests such as in the provision of aggregate anonymous data, to market and to promote our Services. This is a Legitimate Interest Basis.
  • You give us consent. This is a Consent Basis.
  • Needed to comply with a legal obligation. 

9. Your Rights

The rights provided in the current legislation on data protection (General Data Protection Regulation) are recognized in this legal document. You may exercise these rights by sending a written communication to the Data Controller through the contact details indicated above.

If you wish to modify the data that we have registered, you can let us know at any time.

If you do not wish to receive commercial communications about our products and services, you can express your opposition or unsubscribe at any time by sending an email request to privacy@medux.com. Also, all commercial communications that you receive via email allow you to unsubscribe from our emails.

Users have the right to file a claim with the Spanish Data Protection Agency when they believe that the processing of their personal data has violated applicable regulations.

You have the following rights:

  • To be informed about the collection of your personal information
  • To have access to your personal information
  • To have inaccurate personal information corrected
  • To have personal information deleted
  • To request that the processing (use) of your data is restricted. This is not an absolute right
  • To obtain and reuse personal data across different services. This is the ‘Right of Portability’
  • To object to the processing of information. For example, to direct marketing.
  • To object to your data being used for automated decision-making and profiling. Note: we do not do this but this is one of your rights under the GDPR regulation and is added for your information.

We want to ensure that your personal information is accurate and up to date and is being used not only in accordance with the law but with your full knowledge and cooperation. When you want to contact us about your personal information we will first verify that it is you making the request. Normally this will simply be an email from us sent to the email address we have collected for you asking for confirmation of your request.

If you would like us to destroy information we hold about you, please let us know. However, please note that if you use any of our services which require you to provide personal information, deleting our records may mean that you will need to resubmit it to continue using such services.
